• granted, under section 21 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the application by Queensland Institute of Higher Education Pty Ltd for registration in the category of Institute of Higher Education, for a period of five years until 15 September 2026.
• accredited, under section 49 of the TEQSA Act, the applications by Queensland Institute of Higher Education Pty Ltd for accreditation of the following courses for a period of five years until 15 September 2026:
  • Bachelor of Business (Information Systems)
  • Bachelor of Business (Marketing)

Background

Queensland Institute of Higher Education Institute Pty Ltd (QIHE) applied to TEQSA for registration in the category of Institute of Higher Education and for the accreditation of two courses:

• Bachelor of Business (Information Systems)
• Bachelor of Business (Marketing)
• TEQSA considered QIHE's applications and provided a draft assessment report with details of the assessment of QIHE's applications by the responsible assessment team. TEQSA's Commission considered QIHE's response to the draft report and made the decision to approve QIHE's application for registration on 15 September 2021 on the basis that it was satisfied that QIHE met the Higher Education Standards Framework (Threshold Standards) 2021 (HES Framework).

Main reasons for the decision

TEQSA made these decisions on the basis that it was satisfied that QIHE meets the Provider Registration Standards and Provider Course Accreditation Standards of the HES Framework.

On this basis, TEQSA agreed that it was appropriate to register QIHE for a period of five years until 15 September 2026, and to accredit QIHE's Bachelor of Business (Information Systems) and Bachelor of Business (Marketing) courses for the same period.

Report on accreditation of two higher education courses of study offered by Australian College of the Arts Pty Ltd.

On 22 September 2021, a delegate of TEQSA accredited, under section 49 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the following courses offered by Australian College of the Arts Pty Ltd, for a period of seven years until 22 September 2028:

• Graduate Diploma of Ethical Leadership
• Graduate Certificate of Ethical Leadership.

Main reasons for the decision

TEQSA made this decision on the basis that it was satisfied that the courses submitted by Australian College of the Arts Pty Ltd for accreditation meet the applicable Standards of the Higher Education Standards Framework (Threshold Standards) 2021.

Report on accreditation of two higher education courses of study offered by Australian College of the Arts Pty Ltd.

On 22 September 2021, a delegate of TEQSA accredited, under section 49 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the following courses offered by Australian College of the Arts Pty Ltd, for a period of seven years until 22 September 2028:

Report on accreditation of three higher education courses of study offered by Kontea Pty Ltd

On 19 August 2021, a delegate of TEQSA:

• accredited, under section 49 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the following courses offered by Kontea Pty Ltd, until 31 December 2021:
  • Undergraduate Certificate in Cost Estimation for Residential Construction
  • Undergraduate Certificate in Building Information Modelling for Construction Management
  • Undergraduate Certificate in Residential Building Inspection
• imposed, under section 53 of the TEQSA Act, one condition on the accreditation of the Undergraduate Certificate in Cost Estimation for Residential Construction, Undergraduate Certificate in Building Information Modelling for Construction Management, and Undergraduate Certificate in Residential Building Inspection

Condition 1:

Not later than two weeks prior to the commencement of delivery of the course of study, Kontea Pty Ltd must:

provide TEQSA with a report from a suitably qualified independent expert, with the agreement of TEQSA as to the identity of the expert and the terms of reference of their engagement, on its proposed arrangements for delivery of the course online; and

provide TEQSA with Kontea's response, endorsed by the relevant academic governing body, on implementing the recommendations made in the report in paragraph (a).

Main reasons for the decision

TEQSA made this decision in light of risks that the courses submitted for accreditation by Kontea Pty Ltd may not continue to meet, the following provision of the Higher Education Standards Framework (Threshold Standards) 2021:

Standard 3.1.4 of Part A, in relation to whether the course has been designed enable the achievement of expected learning outcomes when delivered in an online mode.

Application to withdraw conditions

In accordance with section 53 of the TEQSA Act, TEQSA may vary or revoke a condition imposed on the accreditation of a higher education course of study, either on its own initiative, or upon application by the provider for variation or revocation.

Report on accreditation of three higher education courses of study offered by Kontea Pty Ltd

On 19 August 2021, a delegate of TEQSA:

• accredited, under section 49 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the following courses offered by Kontea Pty Ltd, until 31 December 2021:

Registration

Report on registration of The Australian Data Institute Pty Ltd

On 10 October 2022, TEQSA:

• granted, under section 21 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the application by The Australian Data Institute Pty Ltd (ADI) for registration in the category of Institute of Higher Education, for a period of 5 years until 10 October 2027.
• accredited, under section 49 of the TEQSA Act, the following courses for delivery by ADI for a period of 5 years until 10 October 2027:
  • Bachelor of Cyber Security
  • Bachelor of Data Science
• imposed, under section 32 of the TEQSA Act, one condition on the registration of ADI.

Condition 1: Corporate Monitoring and Accountability

For the first 5 years after registration, ADI must report to TEQSA if any of the following events occur, based on board accepted management accounts as at 30 June and 31 December each year:

1. The Current Ratio, defined as Current Assets divided by Current Liabilities (excluding related party transactions), falls below 0.
2. The Net Operating Cash Flow falls below projections listed in the revised sensitised forecast of ADI's finances by a margin of 10 per cent or greater.
3. EBITDA, defined as Earnings Before Interest Tax Depreciation and Amortisation, falls below projections listed in the revised sensitised forecast of ADI's finances by a margin of 10 per cent or greater.
4. Closing cash balance falls below projections listed in the revised sensitised forecast by a margin of 10 per cent or greater.
5. The number of commencing and continuing students (domestic and international), and the equivalent full time student load (EFTSL) falls below projections listed in the revised sensitised forecast by a margin of 10 per cent or greater. For both the number of students enrolled and the EFTSL, ADI must provide the actual figures compared to those projected in the sensitised forecast, as well as the budget period.

The reporting, if any of these events occur, must be within 60 days of 30 June or 31 December respectively, based on the board approved management accounts.

Content of reports

The report provided to TEQSA must:

1. be based on ADI's board approved management accounts (which must be provided to TEQSA)
2. include a business plan, revised financial and student projections
3. include all actions and short timeframes planned for correcting negative elements.

For this condition, the revised sensitised forecast is the forecast contained in the Statement of Reasons report provided with the Notice of Decision.

Main reasons for the decision

TEQSA made these decisions on the basis that it was satisfied that ADI meets the Provider Registration Standards and the courses meet the Provider Course Accreditation Standards of the HES Framework. However, TEQSA considered that there remained a risk related to ADI's capacity to meet the Threshold Standards in the future. On this basis, TEQSA decided that it was appropriate to register ADI for a period of 5 years until 10 October 2027, and to accredit ADI's Bachelor of Cyber Security and Bachelor of Data Science courses for the same period.

The five-year period of registration and accreditation is consistent with the basic principles of regulation and reflects risks associated with an applicant for initial registration intending to offer a higher education course but having no history in the provision of higher education.

TEQSA also decided it was appropriate to impose one condition on ADI's registration.

In accordance with section 32 of the TEQSA Act, TEQSA may vary or revoke a condition imposed on the registration of a higher education provider, either on its own initiative, or upon application by the provider for variation or revocation.

Report on the revocation of condition imposed on registration of the University of Southern Queensland

On 21 October 2022 TEQSA revoked, under section 32 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), Condition 1 imposed on the registration of the University of Southern Queensland (refer public report of 26 April 2018).
