    Report on initial CRICOS registration of MEGA Higher Education Pty Ltd

    On 21 February 2025, TEQSA:

    • Approved, under section 10 of the Education Services for Overseas Students Act 2000 (ESOS Act), the registration of MEGA Higher Education Pty Ltd, trading as Higher Education Institute (HEI) on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) until 23 September 2029 to algin with its TEQSA registration.
    • Imposed, under section 10B of the ESOS Act, one condition on the CRICOS registration of MEGA Higher Education Pty Ltd.

    Condition 1:

    1. By 30 December 2026, HEI must engage a suitably qualified independent expert to undertake a review of HEI's first year of delivery to overseas students. The expert and terms of reference for this review must be approved by TEQSA. The review should assess the effectiveness of the implementation of HEI's policies and procedures in ensuring:
      1. responsible recruitment of overseas students
      2. its education agents act ethically, honestly and in the best interests of overseas students
      3. adequate monitoring and support of overseas students.
    2. By 31 March 2027, HEI must provide TEQSA evidence of consideration of the review report, and any actions in response to the report, by its relevant governing bodies.

    Main reasons for the decision

    TEQSA made this decision in light of the risk that MEGA Higher Education Pty Ltd may not comply, or continue to comply with, the following objectives of the National Code of Practice for Providers of Education and Training to Overseas Students 2018:

    • recruit responsibly by ensuring students are appropriately qualified and sufficiently informed for their chosen course (Standard 2)
    • ensure that its education agents act ethically, honestly and in the best interests of overseas students (Standard 4)
    • assist overseas students adjust to study and life in Australia (Standard 6)
    • safeguard the integrity of Australia's migration laws (Standard 8)
    • appropriately manage overseas student enrolment, monitoring and reporting (Standard 9)

    Application to withdraw decision

    In accordance with section 10B(1)(b) of the ESOS Act, TEQSA may vary or revoke a condition imposed on the registration of a registered provider at any time. TEQSA will consider any application by a provider for variation or revocation of a condition.

    On 19 February 2025, TEQSA:

    • renewed, under section 36 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the registration of Australian Institute of Business Intelligence Pty Ltd as an Institute of Higher Education for 7 years until 19 February 2032.
    • imposed, under section 32 of the TEQSA Act, the following conditions on the registration of Australian Institute of Business Intelligence Pty Ltd (AIBI):

    Condition 1: Financial viability and sustainability

    By 31 May 2025, AIBI must provide the following documents to TEQSA to demonstrate AIBI's financial standing has been sufficiently monitored by the Board of Directors:

    1. AIBI's EFTSL and financial projections for the remainder of the 2025 financial year and subsequent 4 financial years
    2. evidence showing:
      1. the financial capacity and sufficiency of back up resources of the ultimate beneficial owners to meet the terms of the Letter of Comfort and Support
      2. the Board of Directors of AIBI have assured themselves of the financial capacity of the ultimate beneficial owners to meet the terms of the Letter of Comfort and Support
      3. if the Board of Directors are not assured of the financial capacity of the ultimate beneficial owners, what contingencies it is putting in place to address the risks arising from this issue

    Condition 2: Staffing

    1. By 30 June 2025, AIBI must engage a suitably qualified independent reviewer to undertake a comprehensive review of the AIBI's oversight and management of staffing as required by Section 3.2 of the Higher Education Standards Framework (Threshold Standards) 2021.
    2. The reviewer and the scope of the review must be approved by TEQSA. The review, in addressing the above, must consider, but is not limited to, the concerns outlined in the assessment report relating to:
      1. senior academic leaders, staff to student ratio, casualisation, and whether AIBI's staffing levels are sufficient to support AIBI's expansion and enrolment growth
      2. the effectiveness of AIBI's oversight and management of risks with specific regard to AIBI's staffing practices and the impact on student needs, academic outcomes and the quality of student experience.
    3. By 31 December 2025, AIBI must provide TEQSA with:
      1. a copy of the completed review report
      2. evidence that AIBI's governing body has considered the review, including any action plans to address or implement recommendations from the review
      3. evidence of progress towards implementing any agreed actions arising from the review

    The conditions will cease to be in effect upon completion of all the above actions.

    Main reasons for the decision

    TEQSA made these decisions in light of risks that Australian Institute of Business Intelligence Pty Ltd (AIBI) may not meet, or continue to meet, the following provisions of the Higher Education Standards Framework (Threshold Standards) 2021:

    1. Financial viability and sustainability: TEQSA is concerned that realistic performance targets have not been established and AIBI does not have the capacity to apply sufficient financial resources (Standards 6.2.1 b and c).
    2. Staffing: TEQSA is not satisfied that AIBI has effectively managed risks related to, and including, the adequacy of its staffing complement for meeting the educational needs of students (Standard 3.2.1).

    Application to withdraw conditions

    In accordance with section 32 of the TEQSA Act, TEQSA may vary or revoke a condition imposed on the registration of a higher education provider, either on its own initiative, or upon application by the provider for variation or revocation.
