    • Imposed, under section 10B of the ESOS Act, one condition on the CRICOS registration of the SAHE Higher Education Pty Ltd.

    ESOS Condition 1 - Admission, Recruitment, and Support of Overseas Students

    1. By 31 December 2024, SAHE must engage a suitably qualified independent expert to undertake a review of SAHE's first year of delivery to overseas students. The expert and terms of reference for this review must be approved by TEQSA. The review should assess the effectiveness of the implementation of SAHE's policies and procedures in ensuring:
      1. responsible recruitment of overseas students
      2. its education agents act ethically, honestly and in the best interests of overseas students.
      3. adequate monitoring and support of overseas students

    2. By 31 March 2025, SAHE must provide TEQSA the review report, evidence of consideration of the review report, and any actions in response to the report, by its relevant governing bodies.

    Main reasons for the decision

    TEQSA made this decision considering the significant risks in the recruitment, admissions and support of overseas students, and the heightened risks for a newly registered provider with no track record of delivery to overseas students. The decision to impose a condition was made on the basis that Southern Academy of Higher Education Pty Ltd (SAHE), may not meet, or continue to meet, all objectives of the National Code of Practice for Providers of Education and Training to Overseas Students 2018 in relation to the recruitment, admission and support of overseas students.

    Application to withdraw decision.

    In accordance with section 10B(1)(b) of the ESOS Act, TEQSA may vary or revoke a condition imposed on the registration of a registered provider at any time. TEQSA will consider any application by a provider for variation or revocation of a condition.

    2. Evidence to demonstrate that NIODA's Academic Governing Board (AGB) and Governing Board (GB) have considered the recommendations of the independent external review, have an action plan with respect to adopted recommendations, have commenced steps from the action plan, and have a timetable for review of the effectiveness of steps from the action plan.

    Main reasons for the decision

    TEQSA made these decisions in light of risks that the course submitted for renewal of accreditation by National Institute of Organisation Dynamics Australia Ltd may not meet, or continue to meet, the following provisions of the Higher Education Standards Framework (Threshold Standards) 2021:

    1. Standards 5.1.2 and 5.1.3 of Part A in relation to the requirement for course approval processes to be overseen by peak institutional academic governance processes and courses are re-accredited only when the decision to approve is informed by overarching academic scrutiny of the course of study.
    2. Standards 5.3.1, 5.3.2, 5.3.3, and 5.3.4 of Part A in relation to the requirement for monitoring, review and improvement to include periodic comprehensive reviews which are informed and supported by internal analysis of student data, external referencing, and benchmarking against comparable courses of study.

    Application to withdraw conditions

    In accordance with section 53 of the TEQSA Act, TEQSA may vary or revoke a condition imposed on the accreditation of a higher education course of study, either on its own initiative, or upon application by the provider for variation or revocation.
