Report on registration of Monaro Education Pty Limited

TEQSA has agreed to orders made by the Administrative Appeals Tribunal (AAT) on 5 August 2024 which:

• grant, under section 21 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the application by Monaro Education Pty Limited for registration in the category of Institute of Higher Education for a period of five years until 31 July 2029.
• accredit, under section 49 of the TEQSA Act, the following courses for a period of five years until 31 July 2029:
  • Bachelor of Business
  • Master of Professional Accounting (Advanced)

Background

On 15 November 2023, TEQSA rejected applications from Monaro Education Pty Limited trading as Monaro Higher Education (MHE) for registration in the category of Institute of Higher Education and accreditation of the Bachelor of Business and Master of Professional Accounting (Advanced) courses.

TEQSA rejected the registration application because it was not satisfied that MHE met the Higher Education Standards Framework (Threshold Standards) 2021 (HES Framework) in relation to:

• Domain 1 Student Participation and Attainment: Standards 1.3.4, 1.5.4
• Domain 5 Institutional Quality Assurance: Standard 5.2.1
• Domain 6 Governance and Accountability: Standard 6.2.1
• Domain 7 Representation, Information and Information Management: Standard 7.2.2.

The decision to reject the accreditation application from MHE was made on the basis that TEQSA cannot accredit a course unless the applicant is a registered higher education provider.

MHE made an application to the AAT for review of TEQSA's decisions. In the course of the proceedings, MHE provided further information and evidence about the matters raised in TEQSA's decision.

Main reasons for the decision

TEQSA assessed the revised evidence provided by MHE as part of the AAT proceedings and considers that MHE now meets the applicable Standards of the HES Framework. TEQSA and MHE therefore jointly requested that the AAT make orders registering MHE and accrediting the courses.

Course accreditation

Report on accreditation of one higher education course of study offered by Chisholm Institute (formerly Chisholm Institute of Technical and Further Education)

On 20 August 2024, a delegate of TEQSA accredited, under section 49 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the following course offered by Chisholm Institute (formerly Chisholm Institute of Technical and Further Education), for a period of seven years until 20 August 2031:

• Associate Degree of Community Mental Health, Alcohol and Other Drugs

Main reasons for the decision

TEQSA made this decision on the basis that it was satisfied that the course submitted by Chisholm Institute (formerly Chisholm Institute of Technical and Further Education) for accreditation meets the applicable Standards of the Higher Education Standards Framework (Threshold Standards) 2021.

Renewal of course accreditation

Report on renewal of accreditation of one higher education course of study offered by Chisholm Institute (formerly Chisholm Institute of Technical and Further Education)

On 20 August 2024, a delegate of TEQSA renewed, under section 56 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the accreditation of the following course offered by Chisholm Institute (formerly Chisholm Institute of Technical and Further Education), for a period of seven years until 20 August 2031:

• Bachelor of Community Mental Health, Alcohol and Other Drugs

Main reasons for the decision

TEQSA made this decision on the basis that it was satisfied that the courses submitted by Chisholm Institute (formerly Chisholm Institute of Technical and Further Education) for renewal of accreditation continue to meet the applicable Standards of the Higher Education Standards Framework (Threshold Standards) 2021.

Renewal of registration

Report on renewal of registration of Australian Academy of Music and Performing Arts

On 28 August 2024, TEQSA renewed, under section 36 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), the registration of Australian Academy of Music and Performing Arts as an Institute of Higher Education, for a period of 7 years until 28 August 2031.

Main reasons for the decision

TEQSA made this decision on the basis that it was satisfied that Australian Academy of Music and Performing Arts continues to meet the applicable Standards of the Higher Education Standards Framework (Threshold Standards) 2021.

• under section 37A of the Tertiary Education Quality and Standards Agency Act 2011(TEQSA Act), the registration of Kontea Pty Ltd in the category of Higher Education Provider to 31 December 2024
• under section 57A of the TEQSA Act, the accreditation of the Bachelor of Construction Management (Honours) to 31 December 2024.

TEQSA made these decisions consistent with the principles set out in TEQSA's policy on extensions to the period of provider registration or course accreditation, including an assessment of risks associated with the extension.

Suspension of ESOS registration

Report on the suspension of the ESOS registration of Kontea Pty Ltd

On 28 August 2024 a delegate of TEQSA suspended the registration of Kontea Pty Ltd under section 83(3)(b) of the Education Services for Overseas Students Act 2000 (ESOS Act).

• The suspension is effective immediately
• Under section 95 of the ESOS Act Kontea must not:
  • do anything for the purpose of recruiting or enrolling overseas students for any course at any location; or
  • solicit or accept any money from an overseas student or an intending overseas student for any course at any location; or
  • if an accepted student has not begun a course - permit the student to begin any course at any location.
• TEQSA has decided that for the whole period of the suspension that paragraph (b) does not apply to Kontea Pty Ltd in relation to overseas students that have already started their course.

Main reasons for the decision

TEQSA made this decision based on concerns regarding Kontea Pty Ltd.'s financial viability and corporate governance.

In particular, TEQSA is concerned Kontea:

• did not meet its obligations under section 29(3) of the ESOS Act to ensure that, at all times, there is a sufficient amount to repay all tuition fees to every overseas student or intending overseas student
• based on its non-payment of the Registered Higher Education Provider (RHEP) charge imposed by the Tertiary Education Quality and Standards Agency (Charges) Act 2021, may not meet the registration requirements of the ESOS Act, considering paragraph 11(h) of that Act
• has shown there are issues with its financial viability and governance
• lacks the financial capacity to address the non-compliance
• has not provided credible evidence to show it is currently ableto meet its obligations under section 29(3).

Right of review

The decision to impose a condition on CRICOS registration is a reviewable decision under Part 7A of the ESOS Act. Kontea Pty Ltd may apply to the Administrative Appeals Tribunal (AAT) for an external review of the decision. Renewal of course accreditation in teach out mode
